Terms and Conditions

Accuracy of Information on the Website: Speed Solar strives to ensure that information on its website is complete, accurate and current. However, despite our best efforts, some information may occasionally be inaccurate, incomplete or out of date. All specifications, products, descriptions and prices of products on the website are subject to change at any time without notice. We make all reasonable efforts to accurately display the attributes of our products. We do not warrant the accuracy or completeness of the information, content or materials provided through the website. The inclusion of any products or services on the website at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

Acceptance of Orders: Speed Solar has absolute discretion in accepting or rejecting any order. An order is not binding upon Speed Solar until it is accepted. By indicating your consent below, you ("Customer") agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and Speed Solar. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and is null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from Speed Solar.

Payment Terms: Speed Solar must receive payment before it will accept an order unless other payment arrangements have been agreed to in writing by Speed Solar. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card or ACH bank transfer. Any other payment method requires the prior written authorization of Speed Solar.

Credit Card Authorization. Credit card issuers may place a temporary "authorization hold" on your account to verify that funds are available for a given purchase. In the event that the security code or billing address supplied by you does not match the records of your card issuer, the transaction will be voided and the order cancelled. However, the card issuer may take up to 7 days to release the funds back into your account. Please contact your credit card issuer for more information on their authorization policies.

Sales and Use Taxes: Speed Solar is only required to collect sales tax on shipments to customers located in Alabama, Arkansas, California, Colorado (partial), Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kentucky, Maine, Maryland, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, North Carolina, Oklahoma, Pennsylvania, South Carolina, Texas, Utah, Vermont, Virginia, Washington, Wisconsin, and Wyoming. Speed Solar does not collect sales tax on sales made to residents of other states. Sales tax is charged based on sales tax legislation on the date of your completed sales transaction. If sales tax was not collected on your sale, you may be liable for Use Tax in your state. You are advised to consult with the Department of Revenue in your state to determine your sales or use tax obligations. This purchase is not exempt from sales or use tax in your state merely because it is made over the Internet or by other remote means. Many states where product purchases are taxable require purchasers to a) file a sales and use tax return or complete the appropriate section(s) on your annual income tax return reporting all purchases that are taxable in the state and for which no tax was collected by the retailer and b) pay tax on those purchases. Additional information on sales and use tax reporting and payment requirements can be found on the Department of Revenue website for your state.

Product Substitution. Products (and country of origin) may be substituted and may not be identical to published descriptions and/or images on our website.

Product Compliance and Suitability. Laws, codes and regulations governing construction, installation, and/or use of products for a particular purpose vary by jurisdiction. Certain products may not be available for sale in all areas. Speed Solar does not guarantee compliance or suitability of the products it sells with any laws, codes or regulations, nor does Speed Solar accept responsibility for construction, installation and/or use of product. It is the Customer's responsibility to review the product application and all applicable laws, codes and regulations for each relevant jurisdiction to be sure that the construction, installation, and/or use involving the products are compliant.

Shipping Charges: Your total cost for purchase of any product will include shipping and handling charges.

Processing Time: You can expect your order to be processed within two business days. Speed Solar aims to ship your order within 5 days of order placement unless otherwise communicated. If you need an item by a certain date, please contact us directly regarding availability of the item and shipping options.

Back Orders: Any items that are unavailable will be placed on back order, and the remainder of your order will be shipped. Estimated ship dates for the remainder of your order will be provided. However, please note that these dates are estimates and is not a guarantee that your order will arrive on that date.

Order Status: Speed Solar will do everything possible to keep you informed of your order via e-mail. A tracking number will be emailed to you once the item is shipped.

Change Orders: Due to the fast turnaround, changes to orders may not be possible. Please call us immediately if you want to change your order, and have your order number available. If your order has not yet been processed and shipped, you may be able to change your order. No changes to the order are possible after the order has shipped.

Shipping Policy: At this time, Speed Solar will only ship to the 48 states within the continental United States. Speed Solar is not responsible for shipping delays by the carrier.

Speed Solar and its vendors carefully inspect all shipments. Customers must inspect their shipments upon delivery prior to signing the release. Customers who will not be signing for their order when it is delivered are responsible to see that the person signing has read and understands Speed Solar's Terms and Conditions.

An independent shipping contractor such as UPS, FedEx or a commercial trucking company will deliver the order. When the shipment arrives the driver will ask the Customer to sign for the delivery. This confirms that the package is being delivered in good condition without damage and that the Customer is waiving any claims against the carrier. Before signing, inspect the package(s) closely on all six sides. Note any box damage including scuffs, dents, tears, punctures or creases on the delivery receipt. If there is anything unusual with the package, the Customer has the right to open it to inspect the contents. If the driver is unwilling to wait while you inspect all of the items, you may mark on the delivery receipt "Concealed Damage Possible".

If there is damage to the shipment, then you must refuse the package and contact Speed Solar immediately.

Important! You or your receiving agent MUST check your order immediately for accuracy and possible concealed damage. No claims for undiscovered damage claims not noted on the delivery receipt will be honored. NO EXCEPTIONS! When we ship we insure proper packaging. It is your responsibility to check your shipment. Your signature on a shipping receipt represents a release of any claims for damage unless noted at the time of receipt.

Returns and Replacements. All panels are tested for power and visually inspected prior to shipping. Manufacturer’s defects are covered under the manufacturer’s warranty on the panels. Any items damaged during shipping will be replaced upon proof of shipping damage.

Governing Law. This Agreement shall be governed in all respects by the laws of the State of Wisconsin, without regard to conflict of law provisions.

Dispute Resolution. The Customer and Speed Solar agree to resolve any claim or controversy at law or equity that arises out of this Agreement or our services (a "Claim") in accordance with one of the subsections below or as otherwise agreed to in writing.

  • Small Claims- For any Claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000, the party requesting relief must file a small claims action in the Circuit Court in Dane County, Wisconsin.
  • Claims for Injunctive or Equitable relief - Claims involving injunctive or other equitable relief, whether or not monetary damages are sought, shall be filed in the Circuit Court of Dane County, Wisconsin.
  • Arbitration – Claims not seeking injunctive or other equitable relief, where the total amount of the award sought is $10,000 or more, shall be resolved through arbitration. under the following terms and conditions:

(a) Arbitration will be in Madison, Wisconsin, and administered by the American Arbitration Association.

(b) Arbitration will be under the commercial Arbitration Rules of the American Arbitration Association. Each party will be entitled to discovery in accordance with the Wisconsin Rules of Civil Procedure.

(c) There will be one (1) arbitrator, who will have knowledge of and experience in dealing with the solar industry.

(d) All discovery will be completed, and the arbitration hearing will commence, within ninety (90) days after appointment of the arbitrator. Unless the arbitrator finds that exceptional circumstances justify delay, the hearing will be completed, and an award will be rendered in writing, within sixty (60) days after commencement of the hearing.

(e) The award rendered in arbitration will be final and binding and may be enforced in any court of competent jurisdiction.

(f) Unless the arbitrator finds that exceptional circumstances require otherwise, the arbitrator will include in the award the prevailing party's costs of arbitration and reasonable attorneys' fees.
